PREAMBLE:

Via our website, by telephone or by any other means of remote communication, you can now register for the services offered by NEOSKI. Registration for services offered by NEOSKI implies pure and simple acceptance of the present general conditions.

ARTICLE I: BENEFITS

NEOSKI’s instructors hold diplomas and a professional card recognized and validated by the French government. They have the prerogatives and a valid authorization to teach skiing and related disciplines. The teaching will be implemented according to the French Skiing Method, codified in the Memento of French Skiing Teaching (published by the French Ministry of Sports), and recognized on a national and international level. This teaching can take place in all environments and on all types of snow appropriate for the acquisition of the skills covered by the Memento.

Services are provided individually or in groups. The good progress of the courses supposes a homogeneity of the level of the skiers. Given the impossibility for NEOSKI instructors to verify the level of each student prior to registration, the student is responsible for the choice of the technical level he or she has selected according to the grid used by NEOSKI. This grid is established by the international ski school ”ESI” and is available on the following link: https://www.ecoledeski.fr/medailles

NEOSKI reserves the right to change a student’s group to a more suitable one, despite the student’s prior declaration of level at the time of registration. This will be done subject to the capacity of the other groups. The student will not be able to claim any reimbursement or compensation for this fact due to his or her declaration alone.

Learning to ski takes place in a specific environment with a random character. Its practice requires the student to personally take care of his own safety and that of others. The responsibility of the instructor is limited to an obligation of means. It is the student’s responsibility to follow the instructor’s instructions. The student is solely responsible for his or her equipment. NEOSKI is not responsible for accidents caused by skiers participating in the course.

ARTICLE II: INSURANCE

The service provider takes out professional liability insurance that covers the instructors in the exercise of their function against damage to a third party as well as the participants during the time they are under the authority of NEOSKI and the instructor. The client and/or student is solely responsible for his or her equipment. The instructors cannot be held responsible for any damage caused by this material or in case of theft or deterioration of it.

ARTICLE III – INSTRUCTOR RESPONSIBILITY

The responsibility of the instructor is limited to an obligation of means. It is the student’s responsibility to follow the instructor’s instructions. The student is solely responsible for his or her equipment. NEOSKI is not responsible for accidents caused by skiers participating in the course.

ARTICLE IV: FEES / REGISTRATION / PAYMENT

4.1 : Rates

NEOSKI’s prices are presented on the website https://www.neoski.fr/. The prices indicated include the teaching service provided by a NEOSKI instructor, to the exclusion of any other service (insurance, ski lifts, accommodation, etc.). The student will have to take a lift pass and, if he/she chooses, an insurance policy that will cover him/her against the risks inherent to mountain sports (civil liability, rescue, etc.). In the event that the student presents himself/herself to the ski course without the appropriate lift pass, he/she will be refused access to the course for the day in question without any reimbursement or compensation being claimed by the client.

4.2 : Registration and payment terms

4.2.1 : For online sales made via our site: you must complete the reservation procedure on this site. With the online payment your reservation will be transmitted to NEOSKI. Your order will be immediately acknowledged by e-mail. The payment is complete at the time of sending your reservation via the NEOSKI website. This payment manifests the conclusion of the contract. It is confirmed by sending an email.
4.2.2 : The purchase is also possible by telephone or by e-mail. A registration will only be considered effective upon receipt of the deposit or balance payment according to the instructions that you will be asked to provide during your discussions with your NEOSKI contact person. In all cases, the payment of a deposit or the balance manifests the implicit conclusion of the contract and the acceptance of the general sales conditions.
4.2.3 : The accepted means of payment are credit cards, checks, cash and bank transfers.

4.3 : Modalities of modification of the service by NEOSKI

In the case of a group class (High-five or Little Mice) with less than or equal to 2 children, the class will be changed to a private class with the same price as the private class. The customer will have the choice to accept the modification or to cancel the service.

Article V – RIGHT OF WITHDRAWAL NOT APPLICABLE REGARDLESS OF THE METHOD OF RESERVATION (ONLINE OR AT THE DESKTOP)

The right of withdrawal within a period of 14 days provided for in Article L221-18 of the Consumer Code is not applicable to the services offered for sale in application of 12° of Article L.221-28, as these are leisure activity services which must be provided on a specific date.

Article VI – AWARDING OF MEDALS (also called badges)

Valid only for minors and for the purchase of 4 consecutive classes, a medal will be given to the student at the last class or at a medal ceremony organized by NEOSKI. This will validate the level reached by the student at the end of the stay. This medal has no cash value and is not eligible for any refund.

Article VII – CANCELLATION OR INTERRUPTION BY CUSTOMER

7.1 : Cancellation before the beginning of the service with full payment :

7.1.1 : Cancellation within 15 days prior to the start of the service: NEOSKI will refund the price paid without justification of the cancellation with a 20 € administration fee.
7.1.2 : Cancellation within 15 days before the beginning of the service : The customer will not be able to claim any refund. NEOSKI informs its customers that it is important to verify your guarantees and insurance in the case of payment by credit card.

7. 2: Interruption during performance:

No refunds can be requested. It is recommended that the customer take out insurance.

ARTICLE VIII – CANCELLATION / INTERRUPTION / EXCLUSION BY NEOSKI

8.1 : Cancellation/interruption

NEOSKI reserves the right to cancel or interrupt lessons in the event that the ski slopes or ski lifts are closed or if the weather conditions make it dangerous for the group to enter the ski area.

8.2 : Refunds

In any of the cases mentioned in article 8.1: NEOSKI will make a refund from the second lesson not taken. NEOSKI would like to remind its clients that ski instruction takes place in a natural environment with extreme and rapidly changing weather conditions. NEOSKI cannot be held responsible for the quality of the weather and snow conditions.

8.3 : Exclusion

NEOSKI reserves the right to exclude at any time a person whose behavior is likely to disturb the course and the safety of the teaching. In this case, the customer will not be entitled to any refund.

ARTICLE IX – INFORMATION HEALTH SITUATION

It is the responsibility of the client and/or student to respect the sanitary rules in force. If the health situation worsens and in the event of new governmental measures that make travel to the resort impossible (such as a lockdown or closure of borders), NEOSKI will propose a postponement or a refund of the sums already paid by the customer. In the event of cancellation by the customer due to contamination at COVID and outside of any governmental injunction, the provisions of Article VII shall apply.

ARTICLE X – RESALE OF SERVICES

Any resale of services offered by NEOSKI is prohibited without prior agreement.

ARTICLE XI – DISPUTE RESOLUTION

The parties shall endeavor to resolve amicably any difficulties that may arise in the execution of the contract. If no amicable agreement can be reached, all disputes relating to the validity, interpretation and performance of this agreement shall be governed exclusively by the rules of French law. All disputes, of any nature whatsoever, will fall under the jurisdiction of the French civil and commercial courts, including those ruling in summary proceedings. CONCLUSION First of all, we would like to thank you for choosing NEOSKI SCHOOL. We would like to inform you that wearing a helmet is mandatory for minors and strongly recommended for adults. In addition, weather conditions can change rapidly in the mountains, so please bring warm and appropriate clothing.
